Conditions Générales de Vente
à la Boutique et à l'Atelier
(ventes effectuées sur le territoire suisse uniquement)
1. Vente
Les conditions de vente sont celles en vigueur à la date de l’édition du tarif.
Les prix s’entendent départ atelier, frais de port et d’emballage en sus. Toute commande entraîne de plein droit l’adhésion de l’acheteur aux conditions générales de vente et, le cas échéant, aux conditions particulières convenues à propos d’une commande spécifique quelles que soient les conditions générales de nos acheteurs.
2. Paiement
Sauf conditions particulières convenues lors d’une commande, nos factures sont payables comme suit : 50% à la commande ou à la confirmation de commande si un devis a été demandé préalablement ; le solde, au moment de la livraison pour les commandes inférieures à CHF 1'200.- et dans les 30 jours (à compter de la livraison) pour les commandes dépassant CHF 1’200.- Ventes à distance : le règlement anticipé de la facture par virement ou BV conditionne la sortie d’atelier de la commande. Le règlement peut aussi être fait en mode Envoi contre remboursement.
Le versement de l’acompte conditionne la mise en chantier de la commande et fait partir le délai annoncé pour l’exécution du travail. A l’exception des cas de retours acceptés par le vendeur, l’acompte n’est pas remboursable et rend la commande définitive.
Le règlement des factures s’effectue, au choix de l’acheteur :

d. Au moyen du bulletin de versement joint à la confirmation de commande, pour l’acompte, et au moyen d’un second bulletin de versement joint aux marchandises, pour le solde de la facture.
3. Délais
Les délais annoncés sont indicatifs. Dans l’impossibilité de fournir totalement ou partiellement une marchandise dans un délai convenu, il ne pourra être réclamé de dommages et intérêts. VdeV CREATION se réserve le droit, notamment dans les cas de commandes importantes, d’effectuer des livraisons fractionnées.
4. Expédition, Responsabilité du Transporteur
Sauf avis contraire de l’acheteur, nos expéditions sont faites par la Poste suisse et assurées contre la perte ou les dommages à hauteur de CHF 500.- Le transfert des risques s’opère dès la mise à disposition des marchandises au transporteur ou à l’acheteur qui s’oblige à les assurer contre tous les risques.
Toutes les marchandises voyagent aux risques du destinataire. Les transporteurs sont seuls responsables des pertes, casses ou avaries. L’acheteur doit vérifier l’état des marchandises à leur arrivée, le transporteur ne peut faire obstacle à ce droit. Un colis peut ne pas avoir de traces de chocs apparentes et néanmoins avoir été manipulé brutalement. Ces dommages doivent faire l’objet de réserves précises, si possible sur le bordereau de livraison, confirmées par lettre recommandée au transporteur dans les 3 jours suivant la réception.
5. Réclamations non-liées au Transport
Défauts apparents : Aucune réclamation pour défaut apparent ne sera acceptée si elle est faite plus de 10 jours après la réception de la marchandise sans réserve, ou si celle-ci a été acceptée, utilisée ou endommagée par l’acheteur. Toute réclamation doit être faite par courrier recommandé adressé à VdeV CREATION dans le délai imparti.
La responsabilité de VdeV CREATION est limitée au prix des marchandises reconnues défectueuses, à l’exclusion de l’indemnisation de tout autre dommage direct ou indirect.
Avertissement : les abat-jour sont des produits fragiles, certains matériaux sont très sensibles à l’humidité, à l’excès de chaleur (rayons infrarouges) et d’UV (rayons ultraviolets) causés par des ampoules de puissance excessive ou placées trop près des parois de l’abat-jour. VdeV CREATION ne peut être tenu pour responsable des dégradations telles que : brûlures, décollage, gondolage, déformation, jaunissement, fonte du PVC, consécutives à un entreposage ou à une utilisation inadéquate du fait de l’acheteur.
A l’exception des cas où elle agit en qualité de concepteur du luminaire, VdeV CREATION réalise ses abat-jour dans le respect des plans, spécifications et instructions indiquées par l’acheteur. VdeV CREATION n’est dès lors responsable ni des erreurs qui pourraient figurer dans ces plans, spécifications ou instructions, ni des défauts de conception imputables à l’acheteur commanditaire.
6. Retour
Aucun retour de marchandises ne peut être fait sans l’accord de VdeV CREATION. Lorsque, exceptionnellement un retour est accepté, celui-ci doit être expédié franco, accompagné d’un document rappelant le numéro et la date de notre facture. Les marchandises retournées ne sont reprises que si elles sont restées dans leur état d’origine. Sans faute ou erreur de la part du vendeur, l’avoir se limitera à 80% du montant de la facture initiale pour couvrir les frais administratifs inhérents à cette opération.
7. Défaut de Paiement
A défaut de paiement dans les délais, VdeV CREATION est en droit de suspendre toute livraison de marchandises à l’acheteur. Après une mise en demeure infructueuse, VdeV CREATION engagera les poursuites judiciaires prévues par la LP. Les coûts en relation avec le recouvrement des factures impayées sont à la charge du vendeur.
Le défaut de paiement à l’échéance fixée, sauf report sollicité à temps et accordé par VdeV CREATION, entraîne l’exigibilité immédiate de toutes les sommes encore dues, quel que soit le mode de règlement prévu.
8. Clause de Réserve de Propriété
Les marchandises fournies restent la propriété de VdeV CREATION jusqu’au dernier jour de leur parfait paiement. Cette réserve de propriété s’exercera de plein droit en cas de faillite ou de liquidation judiciaire, faillite personnelle ou banqueroute. En cas de revendication pour non-paiement partiel ou total, les marchandises en stock chez l’acheteur sont réputées correspondre aux créances impayées. Les acomptes seront conservés pour couvrir les préjudices résultant de la revente du produit.

Les présentes Conditions sont régies et interprétées conformément au droit suisse et du Canton de Vaud. Le for juridique est Lausanne, Canton de Vaud. These Terms are provided in the French language. In the event of any discrepancy between the French version of this document and any translations thereof, the French version shall prevail. You are not permitted to use this Site and our Services if it is prohibited in your country, or by any law or regulation applicable to you.
Before placing and confirming an order, you must read and accept these Conditions.
1. Description of the Products
You must read the description of the Products and Services carefully before placing an order. The description of the Products and Services presents the essential characteristics of the Products and Services. These descriptions are designed to provide you with the most complete information possible on these characteristics, without being exhaustive. The photographs and descriptions of the Products and Services are provided for purely indicative purposes and are not binding on us.
2. Purchase of Products
Any purchase of Products is subject to the Conditions applicable at the time of purchase.
When purchasing a Product, it is your responsibility to read the full product sheet of the items before committing to purchase it. The validation of the order on the Site – which is confirmed by completing the payment procedure and pressing the “Buy” button or a similar button – leads to a legally binding contract for the purchase of the Product concerned.
You can choose from our selection of Products and place the Products you intend to purchase in the shopping cart by clicking on the corresponding button. The prices we charge are mentioned on the Site. We reserve the right to change our prices at any time and to correct any pricing errors that may occur inadvertently. These changes do not affect the price of Products you have already purchased.
At checkout, you will be presented with a summary of all the Products you have placed in your shopping cart. This summary includes the essential characteristics of each product, the total price of all products, as well as the applicable value added tax (VAT). The checkout page also gives you the opportunity to check and, if necessary, remove Products or change quantities. You can also correct any input errors before confirming your order.
To complete the order process you must accept the Terms as legally binding on your order by checking the relevant box in the order form. By pressing the “Buy” button you place a binding order to purchase the advertised Products at the stated price.

After placing the order, an order confirmation will be sent to you by email. This is an automatic message that documents the fact that we have received your order.
We reserve the right not to accept your order.
3. Removal of Products
Due to the fragility of our Products, we do not ship orders by post or courier services.
The collection of the ordered Products is done by appointment either at the workshop or at the store at the addresses below. We will contact you to arrange an appointment when your order is ready for collection. The verification of the conformity of the Products to your order is done at the time of receipt of the Products.

4. Product Warranty
If the Product contains a hidden defect that was not reported to you at the time of purchase, you are entitled to take action under warranty for two years from the discovery of the defect. A hidden defect implies that the Product is unfit for the use for which it is intended, or that it limits its use in such a way that you would not have purchased it, or that you would have purchased it at a lower price if you had been aware of it.
Complaints must be made within eight days of receipt of the goods. Hidden defects must be reported as soon as they are discovered. Damage due to wear, ageing or improper use is excluded from the warranty. The warranty ends if, despite an identifiable defect, you modify or transform the Product.
Where we are responsible for repairing the defect, we undertake to repair any defect covered by the warranty free of charge or, where we consider it preferable and possible, to replace the Product with a similar Product.
Except as expressly provided in the Terms, and to the fullest extent permitted by law, we expressly disclaim all other warranties or conditions, whether oral or written.
5. Limitation of liability
Liability is governed by the applicable statutory provisions. We assume no liability for slight negligence, indirect, incidental or consequential damages, loss of profit or loss of earnings resulting from the use, defects or faults. Unless otherwise specified in writing, the articles are intended exclusively for private use. Any liability is excluded in the context of use for commercial purposes. If you are a professional and are interested in our products and services, please contact us directly.
Lampshades are fragile products, some materials are very sensitive to humidity, excess heat (infrared rays) and UV caused by bulbs of excessive power or placed too close to the walls of the lampshade. We cannot be held responsible for damage such as peeling, warping, deformation, yellowing, melting of the PVC, resulting from improper storage or use of our Products.
We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from any cause beyond our reasonable control or from force majeure.
6. Data protection
Registering on our Shop gives the possibility to create a customer profile. In this context, purchase data and data relating to access to our digital services can be used. During visits to our digital services, information is collected from logs and entered into the customer profile.

7. Modification of the Conditions
We reserve the right to modify these Terms when necessary, so we advise you to review them regularly.

9. Miscellaneous
